1. Agreement to These Terms

These Terms of Service ("Terms") are a binding agreement between you and [LEGAL ENTITY NAME] ("North Fork TV Festival," "NFTV," "we," "us," or "our"). They govern your use of northfork.tv (the "Site"), your purchase of festival passes, your submission of work to our competition, your sponsorship of the festival, and your attendance at our events (collectively, the "Services").

By using the Site or attending the festival, you agree to these Terms. If you do not agree, do not use the Services.


You must be at least 18 years old to purchase passes, submit work, or enter into a sponsorship agreement. Minors may attend where permitted, accompanied by a parent or guardian who accepts these Terms on their behalf.

2. Festival Passes and Tickets


2.1 Purchase


Passes are sold through Eventbrite. Your purchase is also subject to Eventbrite's terms of service. All prices are in U.S. dollars and exclude any applicable taxes and platform fees.


2.2 What a Pass Gets You


Access varies by pass tier. Gold, Silver, and other tiers include different levels of access to screenings, panels, receptions, and special programming such as In-Talks With…. Access to tier-restricted programming requires the corresponding pass. Seating at all events is first-come, first-served, and a pass does not guarantee admission to any specific session once capacity is reached.


2.3 Refunds and Transfers

All pass sales are final and non-refundable. Passes are transferable to another person up to [X] days before the festival by contacting [EMAIL] with the new attendee's name and email address.


If the festival is cancelled in its entirety and not rescheduled, we will provide a refund of the pass price, less non-refundable processing fees. If the festival is postponed or relocated, your pass will be honored at the rescheduled event.


2.4 Programming Changes


Programming, guests, honorees, venues, and schedules are subject to change without notice. The announced participation of any guest is not guaranteed, and a guest's cancellation is not grounds for a refund.


2.5 Travel and Lodging


You are responsible for your own travel and accommodations. Lodging partners linked from our Site operate independently, and we are not responsible for their bookings, rates, cancellation policies, or service.

3. Pilot and Script Competition


3.1 Submissions

Submissions are accepted exclusively through FilmFreeway during announced submission windows and are governed by the competition rules published there, which are incorporated into these Terms. Submission fees are non-refundable, including if your work is withdrawn or found ineligible.


3.2 You Keep Your Rights


You retain all ownership and copyright in the work you submit. Nothing in these Terms transfers ownership of your project to us.


3.3 Limited License You Grant Us


By submitting, you grant NFTV a non-exclusive, royalty-free, worldwide license to:

  • Read, view, and evaluate your submission for judging purposes

  • If selected, exhibit or screen your work at the festival

  • Use your title, logline, name, biography, headshot, and short excerpts or stills (up to [X] minutes for audiovisual work) to promote the festival and its selections, in perpetuity, across any media


3.4 Your Warranties


You represent and warrant that you own or control all rights necessary to submit the work, that it does not infringe any third party's copyright, trademark, privacy, or publicity rights, that all required clearances and releases have been obtained, and that all information in your entry is accurate. You agree to indemnify us against claims arising from a breach of these warranties.


3.5 Judging and Awards


Selections and awards are determined at the sole discretion of NFTV and its jurors. All decisions are final. We do not provide feedback, coverage, or explanations of decisions. We are under no obligation of confidentiality regarding submitted material, and submission does not create any partnership, employment, agency, or joint venture relationship. We regularly receive material that may be similar to yours in theme, premise, or execution, and nothing here limits our or our jurors' ability to develop, produce, or distribute independently created works.

4. Sponsorships


Sponsorship is offered in Gold, Silver, and Bronze tiers and is subject to a separate written sponsorship agreement. Where that agreement conflicts with these Terms, the sponsorship agreement controls for the sponsor. We reserve the right to decline any sponsorship and to require approval of sponsor materials before display.

5. Attending the Festival


5.1 Code of Conduct


The festival is a professional and creative community event. You agree not to engage in harassment, discrimination, threats, intimidation, unauthorized recording, disruption of programming, or any unlawful conduct. We may revoke your pass and remove you from the venue without refund for violating these Terms or venue rules.


5.2 Photography and Recording Release


The festival is photographed, filmed, and recorded. By entering the festival premises, you grant NFTV and its authorized partners the irrevocable right to record your image, likeness, and voice, and to use, reproduce, and distribute that footage in any media for promotional, editorial, and archival purposes, worldwide, in perpetuity, without compensation or further approval. If you do not agree, do not enter the venue.


You may take personal photographs, but recording of screenings, In-Talks With… sessions, and other programming is prohibited without our written permission.


5.3 Venues and Assumption of Risk


Festival programming takes place at venues in and around Greenport, New York, that we do not own or control. You agree to follow all venue rules and the instructions of venue staff. You attend at your own risk and assume the ordinary risks of attending a live public event.


5.4 Alcohol


Where alcohol is served, you must be 21 or older with valid identification. We and our venues reserve the right to refuse service.

6. Newsletter and Communications


By subscribing, you consent to receive email from us about programming, passes, submissions, and festival news. You may unsubscribe at any time using the link in any email. We may still send you messages related to a pass you purchased or a submission you entered.

7. Our Intellectual Property


The Site and its contents — including the North Fork TV Festival name, NFTV, the Canopy Award, logos, text, graphics, photography, video, and design — are owned by us or our licensors and protected by copyright and trademark law. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission, except that you may share links to the Site and use press materials we make publicly available for their intended purpose.

Third-party names, marks, and photographs appearing on the Site remain the property of their respective owners and are used with permission or for editorial purposes.

8. Acceptable Use of the Site


You agree not to:

  • Use the Site for any unlawful purpose

  • Attempt to gain unauthorized access to the Site or its systems

  • Scrape, crawl, or harvest data from the Site by automated means without our permission

  • Introduce malware or otherwise interfere with the Site's operation

  • Misrepresent your identity or affiliation with NFTV

9. Third-Party Services


The Site links to and relies on third-party services including Eventbrite, FilmFreeway, Framer, lodging partners, sponsors, and social platforms. Those services are governed by their own terms and privacy policies. We are not responsible for their content, availability, or conduct.

10. Disclaimers


THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted or error-free, or that information on it is complete or current. Programming details are announced in good faith and are subject to change.

11. Limitation of Liability


TO THE MAXIMUM EXTENT PERMITTED BY LAW, NFTV AND ITS OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOST OPPORTUNITIES, ARISING OUT OF OR RELATED TO THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12. Indemnification


You agree to indemnify, defend, and hold harmless NFTV and its officers, directors, employees, volunteers, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Services, your submitted materials, your conduct at the festival, or your breach of these Terms.

13. Force Majeure


We are not liable for any failure or delay in performing our obligations caused by events beyond our reasonable control, including severe weather, natural disaster, fire, flood, epidemic or pandemic, public health orders, acts of government, labor disputes, utility or venue failure, terrorism, or civil unrest.

14. Governing Law and Disputes


These Terms are governed by the laws of the State of New York, without regard to its conflict of laws rules. You agree that any dispute arising out of or related to these Terms or the Services will be brought exclusively in the state or federal courts located in Suffolk County, New York, and you consent to the personal jurisdiction of those courts.

15. General


Entire agreement. These Terms, together with our Privacy Policy and any competition rules or sponsorship agreements, are the complete agreement between us regarding the Services.

Severability. If any provision is found unenforceable, the rest remains in effect.

No waiver. Our failure to enforce a provision is not a waiver of it.

Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.

Changes. We may update these Terms at any time by posting a revised version with a new "Last Updated" date. Your continued use of the Services after changes take effect constitutes acceptance.
